What’s Happening in Immigration Court? Key Takeaways from Our May 28 Immigration Update 

On Wednesday, May 28, we hosted another Immigration Update livestream with the Illinois Coalition for Immigrant and Refugee Rights (ICIRR) to break down what’s happening in immigration court and how these changes affect our communities. With insights from ICIRR’s Rey Wences, we heard urgent updates and answered questions from community members navigating deportation cases, ICE check-ins, and confusing court procedures.

Here’s a quick summary of what we covered—and what you can do to protect yourself and others. 

1. Court Closures & Confusing Updates Are Hurting Our Community 

Many immigrants are receiving deportation orders without ever receiving a court notice. Others are told by ICE that their cases are closed—only to find out later that this wasn’t true. 

➡️ Bottom line: Even if ICE says your case is closed, double-check with a trusted legal organization. Always verify your court date online at EOIR Case Status Portal or by calling 800-898-7180. 

2. People Are Being Deported Without Warning 

It has been reported that ICE is issuing deportation orders behind closed doors, especially in older cases. In some cases, ICE tells people “Your case is closed” when it’s actually being reopened or fast-tracked for removal. 

➡️ If you had a court case in the past, especially one that was closed without a final decision, talk to a legal representative immediately to check your status. Visit our Legal Assistance page to get trusted legal help. 

3. More ICE Enforcement in Chicago 

Community members shared that ICE is showing up at check-ins and in neighborhoods. Several people have been detained after being told their case was resolved. 

➡️ Never go to an ICE check-in alone if you’re unsure of your legal status. Ask a U.S. citizen to go with you or reach out to a trusted organization, like TRP or ICIRR, for support. 

4. You Still Have Rights 

Remember your rights in court and during interactions with ICE: 

  • You have the right to: 

  • NOT open the door without a signed judicial warrant 

  • Remain silent 

  • Speak with a lawyer 

  • Ask for more time or help understanding your case in court

5. Community Action Is More Important Than Ever 

Our organizations are fighting for accountability and resources—but we can’t do it alone. During the livestream, we heard stories from families who only found out about deportation orders after their loved ones were detained. These stories are a call to action.
